Liability Waiver & Release

By entering, accessing, using, participating in, observing, or remaining on the premises of Friends of Branford Youth Football and Friends of Youth Sports ("Gym"), the undersigned participant, member, guest, visitor, spectator, volunteer, contractor, or any other individual ("Participant") acknowledges and agrees to the following:

ASSUMPTION OF RISK

Participant understands and acknowledges that use of Gym facilities, equipment, services, programs, classes, training, recreational activities, athletic events, locker rooms, parking lots, common areas, and all related activities involve inherent and unforeseen risks including, but not limited to:

• Slips, trips, falls, or collisions
• Equipment malfunction or misuse
• Muscle strains, tears, sprains, fractures, or other injuries
• Heart attack, stroke, medical complications, or death
• Exposure to illness, bacteria, viruses, or communicable diseases
• Negligence of other members, guests, or third parties
• Physical contact with other persons
• Emotional distress or mental injury

Participant voluntarily accepts and assumes all risks, known or unknown, associated with presence at or participation in any activity connected to the Gym.

RELEASE OF LIABILITY

To the fullest extent permitted by law, Participant releases, waives, discharges, and agrees not to sue the Gym, its owners, parent companies, subsidiaries, affiliates, landlords, officers, directors, employees, trainers, contractors, volunteers, agents, representatives, successors, and assigns ("Released Parties") from any and all claims, liabilities, demands, damages, losses, actions, causes of action, costs, attorney fees, or expenses arising from or related to:

• Personal injury
• Bodily injury
• Illness
• Emotional distress
• Property damage or theft
• Economic loss
• Disability
• Death
• Any accident or incident occurring on or around Gym premises or during Gym-related activities

including claims arising from ordinary negligence of the Released Parties.

This waiver applies to all areas of the property, including but not limited to workout areas, courts, turf fields, locker rooms, showers, parking lots, sidewalks, entrances, exits, and off-site events or activities.

HARASSMENT, ASSAULT & MEMBER CONDUCT

Participant understands that the Gym maintains a zero-tolerance policy regarding harassment, discrimination, abuse, assault, threats, intimidation, stalking, bullying, sexual misconduct, inappropriate touching, verbal abuse, recording without consent, or disruptive conduct of any kind.

Participant agrees to behave respectfully toward all individuals on the premises.

Participant further understands and acknowledges that the Gym cannot guarantee the actions, conduct, behavior, or supervision of other members, guests, visitors, or third parties.

To the fullest extent permitted by law, Participant releases the Released Parties from liability arising from:

• Conduct or actions of other members or third parties
• Alleged harassment, including sexual harassment
• Assault or altercations involving third parties
• Member-to-member interactions or disputes
• Theft, loss, or damage to personal property

except where prohibited by law or caused by gross negligence, reckless conduct, or intentional misconduct of the Released Parties.

The Gym reserves the right to deny access, suspend privileges, or terminate participation at any time for violation of Gym policies or unsafe behavior.

MEDICAL & EMERGENCY AUTHORIZATION

Participant represents that they are physically and mentally capable of participating in activities at the Gym and have no condition that would make participation dangerous.

Participant authorizes the Gym to secure emergency medical treatment if deemed necessary and agrees to be solely responsible for all related medical costs and expenses.

RULES & FACILITY USE

Participant agrees to comply with all posted rules, policies, staff instructions, and safety procedures and understands that failure to do so may result in immediate removal from the premises.

Participant accepts full responsibility for any damage caused by their actions or misuse of equipment or facilities.

SURVEILLANCE & SECURITY

Participant understands and consents that portions of the premises may be monitored or recorded by audio and/or video surveillance systems for safety, security, operational, and legal purposes, excluding areas prohibited by law.

ELECTRONIC SIGNATURE CONSENT

Participant agrees that an electronic signature, checkbox acknowledgment, typed name, touchscreen signature, or digital acceptance shall have the same legal force and effect as an original handwritten signature.

Participant acknowledges that by electronically signing this Agreement, they are confirming that they have read, understood, and voluntarily agreed to all terms contained herein.

GOVERNING LAW & SEVERABILITY

This Agreement shall be governed by the laws of the State of Connecticut.

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

PARTICIPANT ACKNOWLEDGMENT & SIGNATURE

By signing below, Participant acknowledges that they:

• Have carefully read and fully understand this Agreement;
• Understand that they are waiving substantial legal rights;
• Voluntarily agree to all terms and conditions contained herein;
• Consent to the use of an electronic signature, which shall have the same legal force and effect as an original handwritten signature;
• Understand this Agreement is binding upon themselves, their heirs, family members, estate, representatives, and assigns.
